{"id":2397,"date":"2009-08-15T14:09:05","date_gmt":"2009-08-15T14:09:05","guid":{"rendered":"http:\/\/the19thfloor.net\/?p=2397"},"modified":"2009-08-15T14:09:05","modified_gmt":"2009-08-15T14:09:05","slug":"justice_is_serv","status":"publish","type":"post","link":"https:\/\/the19thfloor.net\/?p=2397","title":{"rendered":"Justice Is Served"},"content":{"rendered":"<p>I wrote a post a few weeks ago about Riam Dean, the young British woman who was reassigned from her job as an Abercrombie &amp; Fitch store clerk because <a href=\"http:\/\/www.the19thfloor.net\/archives\/2009\/06\/no_employee_dis.html\">her prosthetic arm didn&#8217;t comply with the chain&#8217;s &#8220;look policy&#8221;<\/a>. A U.K. employment tribunal <a href=\"http:\/\/news.bbc.co.uk\/2\/hi\/uk_news\/england\/london\/8200140.stm\">recently ruled that she had experienced unlawful harassment<\/a> and awarded her \u00a38,000 in damages. It also ruled that she did not experience disability discrimination. I don&#8217;t know enough about British employment law to know the standard of proof for establishing a claim of disability discrimination, but I&#8217;m puzzled as to how the tribunal could find that that she was harassed without experiencing discrimination. The facts seem to indicate that her harassment is the direct result of her employer&#8217;s discriminatory attitude regarding her disability. Perhaps some solicitor from across the pond can explain the distinction to me. <\/p>\n<p>Nevertheless, it&#8217;s good to see that Dean received some compensation for the horrible treatment she received.
